Assumption of Risk and waiver of Liability

Com’on Play KIDS provides a safe and fun atmosphere for children and families to enjoy. By reading the following, you are acknowledging and agreeing that “you” are a parent, legal guardian or authorized by a legal guardian and have understood or discussed these terms with such guardian and are authorized to sign this agreement. These terms and conditions pertain to the Com’on Play KIDS facility located at 225 Shops Blvd Suite 107 Willow Park, TX. 76087. As a guest, parent, guardian or other at Com’on Play KIDS, you are specifically waiving your rights, any representative and/or your Participants rights to bring or take any legal action against us at Com’om Play KIDS, our owners, directors, any employees, representatives, volunteers, any affiliates, successors or other related assigns as a result of any bodily injury, permanent disability, or even death. It is understood that these risks may result from a variety of circumstances, to include but not limited to the misuse of any equipment, to include all toys within the facility. You further understand that injuries may also include, but are not limited to, slipping and falling, any sudden medical occurrences, such as heart attacks, strokes, head injuries, sprains, broken bones, muscles injury, cuts and bruises. You agree to assume full responsibility for all risks both current and future that may arise from myself or my participants using any and all facilities at Com’om Play KIDS. You as a guest, parent, guardian or other, agree to assume all risk of loss, theft and damage to personal property belonging to you and the participant while at Com’on Play KIDS. You understand that you are responsible for the cost of any personal property loss, medical, health or personal injury costs related to using and being on the property of Com’on Play KIDS. You understand that in case of a serious medical emergency required your participant and you or your listed emergency contact are unable to be contacted, an owner, employee or representative of Com’on Play KIDS can request immediate emergency medical response and summon the required assistance from emergency personnel such as professional medical personnel, fire or police. Com’on Play KIDS will not be responsible for any medical costs in case of such an emergency. At Com’on Play KIDS, we take pride in a clean atmosphere and disinfection of our personal property. Due to the historic COVID-19 breakout, you are agreeing that you, your household members or current participants here do not have any COVID symptoms and have not had COVID within the last 30 days. The display of pictures taken at Com’on Play KIDS may be viewed and enjoyed on our website, social media platform or during advertisement and marketing. You approve and understand that there may be a chance your participant (child or other) who is part of our Com’on Play KIDS family may have their picture taken as a part of the advertisement. I have read and fully understand this Assumption of Risk and Waiver of Liability and further acknowledge and understand that I am releasing all legal rights. I am doing this freely with full knowledge of the understanding on behalf of myself and minor child or children in which I am the parent, legal guardian or otherwise authorized for the named person (s) below.
